Law”) acting as for and on behalf of the purchaser/owner of the apartment unit since 2019 (the “Client”), in providing legal services in conducting an amicable settlement against one of leading developers in West Jakarta, Indonesia. The Developer has developed mixed use in commercial and residential development (the “Developer”), and committed unlawful acts that have disadvantaged the Client by market and sold the apartment unit on the disputed land (the “Unit”).

 

NMCo. Law Team led by our Managing Partner, Bapak Satrio Kurniawan Siregar, S.H., M.Kn. has conducted legal action by granting the Developer somasi and/or warning to the Developer in order to retain the rights of the Client. During the mediation, the Developer has acknowledged the unlawful acts that have been committed and is willing to amicably and to provide compensation by buy back the Unit.

 

Bapak Satrio commented: “The actions of the Developer who markets and sells apartment units with the basis of land rights that are in the status of legal disputes, is an unlawful act. These actions cause legal uncertainty about the ownership status of the apartment units owned by all the purchaser/owner in general, and specifically the Unit owned by our Client. Thus, the Client has a legal reason to cancel the conditional sale and purchase agreement and receive material compensation from the Developer.”

 

Our Founder Partner, Ibu Nia Sita Mahesa, S.H., M.H. also have the same opinion: “The actions taken by the Developer have fulfilled the elements of tort, therefore, the Developer must be fully responsible for all actions that have disadvantaged the owners of the Apartment units, and specifically the Client.”
